Leave of Absence Policies (FMLA, etc.)

Policy Statement

Spartan Plumbing complies with all applicable federal and Ohio leave laws, including the Family and Medical Leave Act (FMLA) where applicable. This card summarizes leave of absence options available to Spartan employees.

Who This Applies To

All Spartan Plumbing employees. FMLA eligibility has specific requirements (see below).

FMLA (Family and Medical Leave Act)

Eligibility

Employees are eligible for FMLA if they:

  • Have worked for Spartan for at least 12 months
  • Have worked at least 1,250 hours in the past 12 months
  • Note: FMLA applies to employers with 50+ employees — confirm current applicability with Josh as Spartan grows

FMLA Entitlement

  • Up to 12 weeks of unpaid, job-protected leave per year for:
- Serious health condition of the employee

- Serious health condition of a spouse, child, or parent

- Birth or adoption of a child

- Qualifying military family needs

  • Up to 26 weeks for military caregiver leave

FMLA Process

  • Notify Operations Manager as soon as possible when FMLA leave is anticipated
  • Submit a written request to Josh or Operations Manager
  • Provide medical certification if requested (within 15 days)
  • FMLA leave may run concurrently with PTO — confirm with Josh
  • Other Leaves

    • Ohio Parental Leave: Ohio does not currently mandate paid parental leave beyond FMLA protections — confirm any Spartan parental leave policy with Josh
    • Jury Duty: Employees called for jury duty will not be penalized. Notify Operations Manager immediately upon receiving a summons
    • Military Leave: Governed by USERRA. Employees called to active duty receive job-protected leave

    Returning from Leave

    • Notify Operations Manager at least 2 weeks before your anticipated return
    • Provide medical clearance if leave was for a health condition
    • Job restoration rights apply per FMLA rules (same or equivalent position)
